Notice for 112 Axmith Avenue

Take notice that the Committee of Adjustment for the City of Elliot Lake will hold a Hearing on Monday, January 5th, 2026 at the hour of 01:00 P.M. in the Committee Room, main floor at the Municipal Building, 45 Hillside Drive North, Elliot Lake, Ontario, to consider an Application for Minor Variance submitted by Safaa Alhamadani.

Any person interested may, by way of signed, written submission, indicate as to whether they are in favour of or against the application. Such submission shall be accepted by the Secretary-Treasurer prior to the Hearing by December 29th, 2025, and such written submissions shall be available for inspection by any interested person.

112 Axmith Avenue, being more particularly described as Lot 181, according to Plan M-165, recorded and registered in the Land Registry Office for the Land Titles Division of Algoma at Sault Ste. Marie, Ontario.


The applicant is seeking relief from the provisions of the Municipality’s Zoning By-Law No.18-36 and amendments thereto which does not allow an enclosed, covered porch to encroach into the required front yard. The applicant is seeking approval to enclose and cover an existing open front porch and stairs, which will result in an approximate front yard setback of 9’ where the established, existing setback of approximately 15’ only, is permitted.

The decision may be appealed by the applicant, the Minister of Municipal Affairs and Housing, the municipality, or any other person who has an interest in the matter pursuant to s. 45 (12) of the Planning Act to the LPAT within twenty (20) days of the date of the decision.

830 Stanrock Road, being more particularly described as Lot 21, according to Plan 1M-545, recorded and registered in the Land Registry Office for the Land Titles Division of Algoma at Sault Ste. Marie, Ontario.

The applicant is seeking relief from the provisions of the Municipality’s Zoning By-Law No. 18-36 and amendments thereto which states that:

Section 23.2.1.1 – Notwithstanding any other provision in this By-Law, one (1) detached private garage only may be erected per lot as follows:
- Building line from street lot line: same as main bldg.
- Building line from side lot line and rear lot line: 3.0 m
- Building height, maximum: 6.0 m and may contain intermediate floors
- Ground floor area, maximum: 111.5 sqm and not to exceed ground floor area of main building. (04-16)

The applicant is seeking approval to allow the construction of a two-story detached garage with a building height of ~7.5m where a maximum building height of 6.0m is permitted.

The decision may be appealed by the applicant, the Minister of Municipal Affairs and Housing, the municipality, or any other person who has an interest in the matter pursuant to s. 45(12) of the Planning Act to the LPAT within twenty (20) days of the date of the decision.

150 Ontario Avenue, being more particularly described as Lot 72-74, according to Plan M-150, recorded and registered in the Land Registry Office for the Land Titles Division of Algoma at Sault Ste. Marie, Ontario.

The applicant is seeking relief from the provisions of the Municipality’s Zoning By-Law No. 18-36 and amendments thereto which states that:

Section 6.1.1. of the City of Elliot Lake Zoning By-Law 18-36 requires one parking space for each apartment in the building.

The applicant is seeking approval to create three additional apartments on the second floor, in addition to the three existing apartments and existing commercial uses within the building, without providing any on site parking.

The decision may be appealed by the applicant, the Minister of Municipal Affairs and Housing, the municipality, or any other person who has an interest in the matter pursuant to s. 45 (12) of the Planning Act to the LPAT within twenty (20) days of the date of the decision.
